Terms and Conditions

Please note these terms and conditions apply to the A thousand thanks only. All other competitions have been suspended for the time being. Our standard terms and usual competitions will return in due course.

1.      DEFINITIONS

1.1.   The words below, when used in these terms and conditions, shall have the following meaning:

Closing Date” means the time and date when the Competition will close, to be set out on the Competition Page when known.

Competition” shall mean the A thousand thanks as set out in further detail on the Competition Page.

Competition Page” shall mean https://www.goodgoodgiving.org/experiences/a-thousand-thanks

Donation” means a donation to the Prize Fund made in accordance with clause 4 and Donate shall be construed accordingly.

Draw Date” means any date on which a Winner of the Competition will be drawn in accordance with clause 7.1, such dates as set out on the Competition Page.

Entry” shall mean an entry to the Competition.

Opening Date” means the time and date when the Competition will open, as detailed on the Competition Page.

Prize” shall mean one of the sums of £1000 to be awarded as a Prize to Winners of the Competition (or such different sum or prize as notified on the Competition Page from time to time in accordance with clause 8.1).

Prize Fund” means the fund from which Prizes will be awarded, being the sum total of all Donations, less any Prizes awarded, from time to time.

Winner” shall mean a winner of the Competition.

Website” shall mean www.goodgoodgiving.org

2.      THE PROMOTER

2.1. The Promoter is: HIGH PRIZE LTD, a company registered in England and Wales with company number 11766898 and with a registered address at 102 Fulham Palace Road, London, England, W6 9PL

2.2.   The Promoter operates the Competition subject to and in accordance with these terms and conditions.

3.      THE COMPETITION

3.1.   The Competition Page shall include full details of the Competition, including:

3.1.1.    the Prize;

3.1.2.    the Prize Fund / number of Prizes available (updated regularly but not in real time);

3.1.3.    the Entry Fee;

3.1.4.    the Opening Date;

3.1.5.    the Closing Date; and

3.1.6.    the Draw Dates.

3.2.   The Competition will be open from the Opening Date to the Closing Date.

3.3.   The Promoter shall operate the Competition on a not-for-profit basis, meaning:

3.3.1.    100% of Donations made to the Prize Fund will be awarded as Prizes (or, in the case of any excess, donated to relevant NHS approved or affiliated charities); and

3.3.2.    the Promoter will cover the administrative, legal and operating costs incurred in running the Competition.

4.      HOW TO DONATE

4.1.   You can donate to the Prize Fund by following the instructions on the Website.

4.2.   Once received, we are unable to refund or reverse Donations (so please make sure the amount transferred is correct).

5.      HOW TO ENTER

5.1.   Subject to being eligible (in accordance with clause 6), the Competition is free to enter provided that each entrant shall only be permitted to win one Prize and each person will only be allowed one live Entry at any time.

5.2.   To enter the Competition you must follow the instructions on the Competition Page and complete and submit the online entry form provided on the Website by the Closing Date.

5.3.   You are responsible for ensuring the contact details you provide are correct.

5.4.   Postal entries will not be accepted.

5.5.   You may not submit an Entry on behalf of another person and joint submissions are also prohibited.

5.6.   All Entries must be received by the Promoter by the Closing Date. All Entries received after the Closing Date will automatically be disqualified.

5.7.   By submitting an Entry, you are agreeing to be bound by these terms and conditions.

6.      ELIGIBILITY

6.1.   Subject to 6.2, the Competition is open to National Health Service (NHS) workers in the United Kingdom who are aged 18 years or over.

6.2.   Before being able to enter the Competition you will be required to enter your NHS email (for verification purposes).

6.3.   The following persons are not eligible to enter the Competition:

6.3.1.    employees of the Promoter or its holding or subsidiary companies;

6.3.2.    employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration;

6.3.3.    professional advisers or anyone else connected with the development or operation of the Website or the Competition in any way;

6.3.4.    members of the immediate families or households of 6.3.1 to 6.3.3.

6.4.   In entering the Competition, you confirm that you are eligible to do so and eligible to claim a Prize in the event you are a Winner. Before transferring a Prize to you the Promoter may require further proof if it has any reason to suspect you may not be so eligible.

6.5.   You are responsible for determining whether your accessing and/or use of the Website and/or Entry into the Competition is compliant with all applicable laws, regulations, rules and guidelines to which you are subject and you warrant to us that your participation in the Competition will not breach any such laws, regulations, rules and/or guidelines.

7.      SELECTION OF WINNER

7.1.   All Winners will be selected by a computerised random number generator from all valid Entries as at the Draw Date. In each draw, the person whose Entry is drawn first will be the Winner.

7.2.   The decision of the Promoter with regards to the Winner and/or which Entry was drawn first is final, and no correspondence or discussion will be entered into in respect of the same.

8.      THE PRIZE

8.1.   The Promoter reserves its right to alter the Prize awarded to Winners of the Competition from time to time (and any such changes will be set out on the Competition Page) if circumstances beyond the Promoter’s control makes it necessary or desirable to do so.

8.2.   The Promoter will not be responsible for any incidental costs or expenses related to a person’s acceptance of a Prize (including any tax liability which may arise). Any such costs are the sole responsibility of a Winner.

8.3.   The Prize is not negotiable.

8.4.   Each Winner must comply with: any reasonable directions or instructions given by the Promoter and/or their agents, together with all relevant laws, rules, regulations, restrictions, guidelines or requirements. Failure to comply with directions, itineraries, laws, rules, regulations, restrictions, guidelines or requirements may result in the relevant Entry being deemed invalid and/or forfeiture of a Prize.

9.      CLAIMING THE PRIZE

9.1.   The Promoter will make reasonable efforts to contact the relevant Winner(s) as soon as practicable after each Draw Date, using the email address provided with an Entry. Such Winner must then formally claim the Prize by sending an email to winner@goodgoodgiving.org, within 7 days of the relevant Draw Date.

9.2.   If a Winner cannot be contacted or is not available, or if a Winner has not claimed their Prize within 7 days of the Draw Date (which may be extended at the sole discretion of the Promoter), such claim will become invalid, the Winner will forfeit the Prize and the Promoter will repeat the process at 7.1 with the other valid Entries, and then award the Prize to the person whose Entry which is drawn first (the “Alternate Winner”). The Promoter will make reasonable efforts to contact the Alternate Winner as soon as practicable, using the telephone number or email address provided with their Entry. Such Alternate Winner must then formally claim the Prize by sending an email to winner@goodgoodgiving.org, within 7 days of the re-arranged Draw Date. If the Alternate Winner does not claim the Prize within such period, this process will be repeated until a Winner is selected and the Prize is claimed. For the avoidance of doubt, once a Prize has been forfeited by a person who was a Winner but failed to claim within the respective period, such person will have no claim against the Promoter. If an Alternate Winner is selected, they shall be deemed to be a “Winner” for the purposes of these terms and conditions.

9.3.   Before any Prize is transferred, the Promoter reserves its right to require a Winner to provide a certified copy of their passport, driving licence or NHS ID card to the Promoter to confirm their identity, age and address and any further information reasonably need to confirm that the Winner was (at the time of their Entry) eligible to enter the respective Competition.

9.4.   If a person fails to meet the obligations listed at 9.3, the Promoter reserves the right to disqualify the Winner and select an Alternate Winner by repeating the process set out at clause 7.1 with the other eligible Entries.

9.5.   Following the receipt and verification of any details requested by the Promoter, the Winner will be contacted in order to make arrangements for the award of the Prize.

9.6.   A Prize may not be claimed by a third party on behalf of a Winner.

9.7.   The Promoter does not accept any responsibility if a Winner is not able to receive a Prize for any reasons outside of the Promoter’s control.

9.8.   A Winner must comply with all reasonable requests of the Promoter with regards to the award of a Prize.

10.    LIMITATION OF LIABILITY

10.1.Nothing in these terms shall limit or exclude the Promoter’s liability for death or personal injury caused by its negligence or any matter in respect of which it would be unlawful for the Promoter to exclude or restrict liability

10.2.Subject to clause 10.1, and insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to a Winner, or any other person, or accept any liability for any loss (including consequential loss), damage, personal injury or death which results from a person receiving a Prize or otherwise results from any Competition

10.3.If due to reasons of hardware, software or other computer-related failure, or due to human error a Prize is awarded incorrectly, the Promoter reserves its right to reclaim the Prize and award it to a person who should have been awarded the Prize, at its sole discretion and without admission of liability. The Promoter shall not be liable for any economic or other consequential loss suffered or sustained by any persons to whom a Prize has been incorrectly awarded, and no compensation shall be due.

10.4.The Promoter will not accept responsibility for Entries that are lost, delayed, or otherwise not received including as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

10.5.The Promoter does not guarantee that the Website will be available and/or error free at all times. The Website may be suspended temporarily and without notice in the case of any problem with any network or line, system, server, software, or for any technical malfunction or failure, maintenance or repair or for reasons reasonably beyond the control of the Promoter and the Promoter does not accept responsibility for the inability of any person to submit an Entry in such instance

10.6.The Promoter does not accept any responsibility or liability if a person is unable for any reason to take up a Prize.

11.    OWNERSHIP OF ENTRIES AND INTELLECTUAL PROPERTY RIGHTS

11.1.All Entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

12.    DATA PROTECTION

12.1.The Promoter will only process and store your personal information as set out in its privacy policy, available on the Website.

13.    BREACH OF TERMS AND CONDITIONS

13.1.You agree to reimburse the Promoter in respect of any damages or losses suffered by the Promoter arising as a result of or in direct connection with your breach of these terms and conditions or from your violation of any applicable law or regulation

13.2.The Promoter reserves the right to void an Entry if it has reasonable grounds for believing that an Entry has breached any of these terms and conditions

13.3.The Promoter reserves the right to exclude a person from participating in the Competition if there is any reason to believe that such participation would result in a breach of these terms and conditions or if the Promoter deems that person’s conduct to be contrary to the spirit or intention of the Competition.

14.    GENERAL

14.1.The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so. A notice in respect of any material change will be posted on the Website.

14.2.These terms and conditions shall be governed by the law of England and Wales.

14.3.  The parties submit to the exclusive jurisdiction of the English courts.
